PromoStream™, PromoJuice™, and PromoTix™ are owned Trademarks of PromoTix, Inc. and are committed to protecting your privacy. This Statement of Privacy applies to the PromoStream, PromoJuice, and PromoTix websites and online software applications, mobile apps for iOS, and mobile apps for Android. PromoTix, Inc. governs data collection and usage at all PromoTix, Inc. sites and services; it does not apply to other online or offline sites, products, or services. Please read the PromoTix, Inc. Statement of Privacy. PromoTix, Inc. is a general audience website, intended for users of all ages. Personal information of all users is collected, used, and disclosed as described in this Statement of Privacy by PromoTix, Inc.
Some Information is contributed to the website and software applications by users in a public-facing manner, accessible by other users on the platform, and by using the website and software applications you agree not to hold PromoTix, Inc. responsible for any user-generated content which you may share or which has been shared with you or the general public.
As a platform-based website application and mobile app, PromoTix, Inc. and trademarks PromoStream, PromoJuice, and PromoTix, collect personal information, such as your email address, social media accounts, bank and credit card information, name, home or work address or telephone number and more. We also collect analytics information about your usage of our application and website across all of our platforms and use cookies within your web browser. Information collected by PromoTix, Inc. is used solely for the purpose of billing for your purchases and depositing funds due to you in your account and/or using your information for our own marketing purposes including retargeting. PromoTix, Inc. encourages you to review the privacy statements of Web sites you choose to link to from PromoJuice, and PromoTix so that you can understand how those Web sites collect, use and share your information. We are not responsible for the privacy statements or other content on Web sites outside of the PromoTix, Inc. owned properties.
PromoTix, Inc. and its operational service partners collect and use your personal information to process product orders and deliver the products requested. It is possible that PromoTix, Inc. may also use personal information to inform you of other products or services available from PromoTix, Inc. and its affiliates. PromoTix, Inc. may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered. Contact may be made by email, mail, phone, push notification, or text messaging.
PromoTix, Inc. does not sell, rent or lease its customer lists to third parties. PromoTix, Inc. may, from time to time, contact you on behalf of its business partners and clients about a particular offering that may be of interest to you. In those cases, your personal information (e-mail, name, address, telephone number) is not transferred to the third party.
PromoTix, Inc. provides a fee-free ticketing product that is supported by Sponsors. In the case of a Sponsor based relationship, whereby the Sponsor pays for your ticket service fees as approved by the event organizer, and you choose to complete the transaction, we may share your contact information with the Sponsor, and the Sponsor may choose to reach out to you at a later date independently from PromoTix, Inc.
We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing customer support, processing transactions, or performing statistical analysis of our services. We will only provide those companies the personal information they need to deliver the service. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose.
PromoTix, Inc. does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.
PromoTix, Inc. may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on PromoTix, Inc. or the site; (b) protect and defend the rights or property of PromoTix, Inc., including its Web site; or (c) act under exigent circumstances to protect the personal safety of users of PromoTix, Inc. or the public.
Personal information collected on this site may be stored and processed in the United States or any other country in which PromoTix, Inc. or its affiliates, subsidiaries, or agents maintain facilities, and by using this site, you consent to any such transfer of information outside of your country. PromoTix, Inc. abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union.
You may stop the delivery of future promotional emails from PromoTix, Inc. by unsubscribing at the bottom of any promotional email that you receive with a request to remove you from the mailing list. You may also be removed from any text messaging marketing service by following the instructions sent to you when you first receive a text. By utilizing our application, you agree to allow us to utilize any analytical information we collect on you and any cookies we place for marketing purposes online, or to contact and/or deliver services to you.
You may request the deletion of your personal information by emailing us or contacting us through the website. If you request a deletion of your personal information, we may keep certain usage data about your account's previous use of our application in an anonymous form not tied to your name or contact information. You will not receive any reply or confirmation of any data removal requests since emailing you or responding to your request would then re-store your personal information back into our system.
Your Business contact information at times may be found publicly on the applications and websites owned by PromoTix, Inc.
Any one persons account, including those members of your team in which you ask to join your Street Team, those who purchase tickets to your events, guests of your event, or those who register for your events on PromoJuice, and/or PromoTix, will be provided independent accounts and as such is considered an independent client that belongs to PromoTix, Inc. PromoTix, Inc. reserves the right to market to and solicit anyone as a Client or member of the application with New Opportunities regarding other Campaigns and Shows other users may create. Any Campaigns and campaign data that is pushed live on the platform will be organized and marketed in multiple ways across the platform. Any information regarding the quantity of ticket sales, dollar amounts of ticket sales, social media shares, posts, or accounts, number of street team members or campaigns, GPS locations or other geographic data, dates, times, images, photographs, videos, preferences, performance data, and any other information collected by PromoTix, Inc. that you enter into any platform or website may be used and displayed as PromoTix, Inc. decides for the benefit of the users of any PromoTix, Inc. owned platform and the company’s own benefit. This collaboration of information is essential to the functionality of the platform, and you Agree that PromoTix, Inc. has full discretion over how this information shall be used and shared.
PromoTix, Inc. is committed to protecting the security of your financial information, such as your revenues, credit card information, and bank account information. We use a variety of security technologies and procedures to help protect your financial information from unauthorized access, use, or disclosure. For example, we store the financial information you provide on computer systems with limited access, that are located in controlled facilities. When we transmit highly confidential information (such as a credit card number) over the Internet, we protect it through our processor as we are PCI Compliant. We are not responsible for your financial information once passed through third-party integrations such as Stripe. Please review app integrations you utilize, such as Stripe, for details on their privacy policies and terms.
All Users shall have access to basic account features and shall Agree and be bound to the PromoTix, Inc. End User License Agreement. If you do not agree with the End User License Agreement, do not use the software. Your information will be shared with Ambassadors and Event Organizers for the events you purchase tickets to or register for.
If you decide to participate in any Ambassador Street Team opportunities to help promote events on the platform, your account will be upgraded to display Ambassador features. PromoTix, Inc. only facilitates relationships between Event Organizers on the platform and Ambassadors and is not responsible for offers to you made by Event Organizers or the fulfillment of those offers, including but not limited to prizes or payment for promotional services performed by the Ambassador on behalf of the Organizer. As an Ambassador it is your responsibility to do due diligence on the Event Organizer and their offers on the platform before committing to participate in their campaign. Your information will be shared with the Event Organizer should you accept and participate in one of their campaigns or offers.
If you decide to create an event on the platform, your account shall be upgraded to an Event Organizer account and display event organizer features. You shall Agree and be bound by the additional Event Organizer Payment and Use Terms and Conditions Agreement. Your information will be shared with Ambassadors and Attendees who purchase tickets to your events.
PromoTix, Inc. will occasionally update this Statement of Privacy and Terms of Use to reflect company and customer feedback. If there are material changes to this Statement or in how PromoTix, Inc. will use your personal information, PromoTix, Inc. will prominently post such changes prior to implementing the change. PromoTix, Inc. encourages you to periodically review this Statement to be informed of how PromoTix, Inc. is protecting your information.
You agree to be bound by Mediation and forego your right to any lawsuit in a court of law, should any disagreement arise between you and PromoTix, Inc. for any reason, upon your creation of an Account and use of the platforms or websites owned by PromoTix, Inc.
YOU AGREE BY USE OF THE SOFTWARE, TO USE THE SOFTWARE AT YOUR OWN RISK, TO INDEMNIFY, PROTECT, AND HOLD HARMLESS PROMOTIX, INC., ITS SUBSIDIARIES, ASSIGNS, SPONSORS, PARTNERS, SHAREHOLDERS, EMPLOYEES, AND BOARD MEMBERS, FROM ANY AND ALL CLAIMS ARISING OUT OF YOUR USE OF THE SOFTWARE WHAT-SO-EVER, INCLUDING BUT NOT LIMITED TO, BUGS WITHIN THE SOFTWARE, DOWNTIME OF SERVERS, CALCULATION ERRORS, DATA LOSS, INABILITY TO ACCESS YOUR ACCOUNT, SPEED OF SERVICES, RESPONSIVENESS, EQUIPMENT FAILURE, CLERICAL ERRORS, BILLING ERRORS, DATA BREACHES, UNAUTHORIZED USE OF YOUR ACCOUNT, USER-GENERATED INFORMATION DISPLAYED ON THE WEBSITE, OR OTHER.
